Protecting your private information is our priority. This Privacy Statement governs the collection, processing, and use of User and/or Customer data.

For purposes of this Privacy Policy, unless otherwise noted, all references to Zoes Media Lab, include https://www.zoesmedialab.com, other websites or subdomains operated by us, any of our mobile applications (collectively, the “Site”) and Zoes Media Lab, LLC, its subsidiaries, and affiliates (“Zoes,” “We,” “Us” or “Our”).

1.2. The terms “You” or “Your” refer to You, the user(s) of the Site, regardless of whether You are an individual natural person, whether You are using the Site in conjunction with another person or persons, or whether You are an entity

1.3. Zoes is an independent media lab that uses codeless and AI tools to help businesses of all sizes take their online presence to the next level (the “Services”), although we reserve the right to modify our business
or the Services at any time in our sole discretion.

2. Collection of your personal information.

2.1. Zoes may collect personal information about you, including, but not limited to your:

  • 2.1.1. Full name.
  • 2.1.2. Contact information (e.g., e-mail, address, telephone number).
  • 2.1.3. Date of birth.
  • 2.1.4. Social Security/EIN number.
  • 2.1.5. Driver’s license number.
  • 2.1.6. Financial and income information.
  • 2.1.7. Professional information.
  • 2.1.8. Recording telephone calls with our agents.
  • 2.1.9. Any other information that you voluntarily provide to us, including, but not limited to, information that you provide to us by filling out any forms or informing us of your preferences, etc
2.2. We do not collect any personal information about you unless you provide it to us voluntarily. However, you may be asked to provide us with certain personal information when you choose to use the Services available on the Site. These may include:
  • 2.2.1. Entering information for a link sponsored by us or one of our partners.
  • 2.2.2. Subscribing to special offers from selected third parties.
  • 2.2.3. The sending of an e-mail message.
  • 2.2.4. Making contact calls.
  • 2.2.5. Submitting your credit card or other payment information for payment processing by a third party (for example, without limitation, HoneyBook, etc.).

2.3. Namely, we will use your information to, among other things, communicate with you in connection with your use of the Services.

3. Sharing Information.

3.1. Zoes may disclose potentially personally identifying and personally identifying information to its employees, contractors and affiliated organizations that: (i) need to know that information in order to process it on Zoes’ behalf or to provide services available on the Site and (ii) that have agreed, to the best of our knowledge, not to disclose it to third parties. Some of those employees, contractors and affiliated organizations may be located outside of your home country or jurisdiction; by using the Site, you consent to the transfer of such information to them. However, Zoes will never share your phone number with any third party unless required to do so by law or by a judicial or administrative authority.

3.3 SMS opt-in or phone numbers for the purpose of SMS are not being shared with any third party and affiliate company for marketing purposes.

4. Tracking User Behavior.

4.1. Zoes may, in its sole discretion, track which websites and pages our users visit within the Site, whether by desktop or mobile device, in order to determine which Zoes services are the most popular. This data is used to present customized content and advertisements on the Zoes Site to users whose behavior indicates that they have a particular interest in a given area

5. Information Collected Automatically.

5.1. Zoes may automatically collect information about your computer hardware, mobile devices, and software. This information can include: your IP address, browser type, domain names, access times and referring Web site addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the site.

6. Use of Cookies.

6.1. The Zoes Web site may use “cookies” to help you personalize your online experience

For example, if you personalize Zoes pages or subdomains, a cookie helps Zoes to recall your specific information on subsequent visits. When you return to the Site, the information you previously provided can be retrieved, so you can easily use the Zoes features that you customized

7. Web Beacons.

7.1. We may also use a technology called web beacons to collect general information about your use of the Site. The information we collect through web beacons allows us to statistically monitor the number of people who open our emails. Web beacons also help us understand the behavior of our users, customers, members, and visitors

8. Transfer of Business.

8.1. If Zoes undergoes a change of control (as defined herein) your personal information may become an asset of such a transaction.

8.2. You acknowledge that such transfers may occur, and that any acquirer of Zoes may continue to use your personal information as set forth in this policy.

8.3. As used herein, “Change of Control” means:

8.3.1. A consolidation or merger of Zoes with or into any other corporation or other entity or person, or any other corporate reorganization, other than any consolidation, merger, or reorganization in which the shares of capital stock of Zoes immediately prior to such consolidation, merger or reorganization continue to represent a majority of the voting power of the surviving entity immediately after such consolidation, merger or reorganization.

8.3.2. Any transaction or series of related transactions to which Zoes is a party and in which more than 50% of the voting power of Zoes is transferred.

8.3.3. The sale or transfer of all or substantially all of the assets of Zoes, or the exclusive license of all or substantially all of the material intellectual property of Zoes; provided that a Change of Control shall not include any transaction or series of transactions primarily for bona fide equity financing purposes in which Zoes or any successor receives cash, the cancellation or conversion of Zoes’ indebtedness or any combination thereof

9.1. The Site may contain links to third party sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave
our site and to read the privacy statements of any other site that collects personally identifiable information.

10. Security of Your Personal Information.

10.1. Zoes secures your personal information from unauthorized access, use or disclosure.

10.2. Zoes uses the following methods for this purpose:

13.1. From time to time, we may contact you via telephone call or text message to send you alerts, confirmations, surveys and/or other general communications. You may opt out of receiving such communications by contacting us.

13.2. The use of text messages as a means of communication with you is obtained only with your express consent, provided voluntarily by you. Such consent is obtained verbally. You have the right to object to receiving this type of communication by contacting us.

13.3.You agree that telephone calls and text messages sent by the Company will only be recorded and stored for quality and security control purposes.

13.4.The processing of personal data of users through phone calls and text messages is based on the legitimate interest of Zoes to ensure the security of its systems and services, as well as to improve the quality of its customer service.

13.5. In any case, Zoes will never share the customer’s and/or user’s personal data with third parties without your express consent.

14. External Data Storage Sites.

14.1. We may store your data on servers provided by third party hosting providers with whom we have contracted.

15. GDPR and Privacy Rights of Designated Countries.

15.1. This section only applies to users and customers of the Services who are in the European Economic Area, United Kingdom and/or Switzerland (collectively, the “Designated Countries”), at the time of data collection.

15.2. We may ask you to identify the country in which you are located when you use some of the Services, or we may rely on your IP address to identify the country in which you are located. If we rely solely on your IP address, we may not apply the terms of this Section to any User or Customer who masks or otherwise conceals his or her location information so as not to appear to be in the Designated Countries.

15.3. If any of the terms of this Section conflict with other terms contained in this Policy, the terms of this Section shall apply to Users and Customers in the Designated Countries.

15.4. Zoes is a data controller with respect to any personal information collected from customers or users of its Services. A “data controller” is an entity that determines the purposes for which and the way any personal information is processed. Third parties acting as our service providers are “data processors” who process your personal information in accordance with our instructions.

15.5. You may object to our processing at any time and as permitted by applicable law if we process your personal information on the lawful basis of consent, contract, or legitimate interests. We may continue to process your personal information if it is necessary for the defense of legal claims, or for any other exception permitted by applicable law.

15.6. If we process your personal information based on a contract with you or on your consent, or the processing is carried out by automated means, you may request to receive your personal information in a structured, commonly used, machine-readable format and to have us transfer your personal information directly to another “data controller”, where technically feasible, unless exercising this right would adversely affect the rights and freedoms of third parties.

16.1. The CCPA provides California residents with specific rights with respect to their personal information. This section describes your CCPA rights and explains how to exercise those rights.

16.2. You have the right to request that Zoes disclose to your certain information about our collection and use of your personal information during the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • 16.2.1. The categories of personal information that we have collected about you.
  • 16.2.2. The categories of sources of the personal information we collect about you.
  • 16.2.3. Our business or commercial purpose is for collecting, processing, using, and transferring personal information.
  • 16.2.4. The categories of third parties with whom we share that personal information.
  • 16.2.5. The specific personal information we have collected about you (also referred to as a data portability request).
  • 16.2.6. If we transfer or disclose your personal information for a business purpose, two separate lists indicating: sales, identifying the categories of personal information each category of recipient acquired; and disclosures for a business purpose, identifying the categories of personal information each category of recipient obtained.

16.3. You have the right to request that we delete any personal information about you that we have collected and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and will make reasonable efforts to direct our service providers to delete) your personal information from our records, unless an exception applies.

16.4. We may deny your request for deletion if the retention of the information is necessary for us or our service provider(s) to be able to:

  • 16.4.1. Complete the transaction for which we collected the personal information, provide the good or service you requested, take reasonably anticipated action in the context of our ongoing business relationship with you or otherwise fulfil our contract with you.
  • 16.4.2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activities, or prosecute those responsible for such activities.
  • 16.4.3. Debug products to identify and repair bugs that affect their intended functionality.
  • 16.4.4. Exercise freedom of speech, ensure the right of another consumer to exercise his or her free speech rights, or exercise any other right provided by law.
  • 16.4.5. Comply with the California Electronic Communications Privacy Act (California Penal Code section 1546 et seq.).
  • 16.4.6. Participate in public or peer-reviewed scientific, historical or statistical research in the public interest that complies with all other applicable ethics and privacy laws, when the deletion of the information would make it impossible or seriously impair the conduct of the research, provided that you have previously given your informed consent.
  • 16.4.7. Allow only internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • 16.4.8. To comply with a legal obligation.
  • 16.4.9. Make other internal and lawful uses of that information that are consistent with the context in which you provided it.

16.5. To exercise the rights of access, data portability and deletion described above, send us a verifiable request from the consumer by any of the following means:

  • 16.5.1.By sending us an email or letter to the contact information listed in this Policy.

16.6. Only you, or a person registered with the California Secretary of State whom you authorize to act on your behalf, may make a verifiable consumer request regarding your personal information. You may also file a verifiable consumer application on behalf of your minor child.

16.7. You may only submit a verifiable request for access or data portability twice in a 12-month period. The consumer’s verifiable request must:

  • 16.7.1. Provide sufficient information to allow us to reasonably verify that you are the individual about whom we collect personal information or an authorized representative.
  • 16.7.2. Describe your request in sufficient detail to enable us to understand, evaluate and respond to it appropriately.

16.8. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. We will only use the personal information provided in a verifiable consumer application to verify the applicant’s identity or authority to make the request.

17. Rights of Users and/or Customers.

17.1. You have the right to access, rectify or delete your personal data. You also have the right to object to the processing of your personal data. To exercise these rights, you can contact us.

18. Changes to this Statement.

18.1. We reserve the right to modify this Privacy Policy from time to time. We will notify you of significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site and/or by updating any privacy information on this page.

18.2. Your continued use of the Site and/or the Services available through this Site following such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by such Policy.
